$4 Million Motorcycle Accident

On June 26, 2014 a collision occurred between a motorcycle and tree-trimming truck in Phelps County, Missouri. The collision killed one passenger on the motorcycle and injured the other. The family of the deceased filed a lawsuit for wrongful death against the truck’s parent company, Bakomax.

AW Smith Law represented the children of the deceased. The truck driver’s negligent action caused the collision, making the tree trimming service vicariously reliable for damages.

A settlement was reached following the deposition of the truck driver. Judge Jon Beetem, a Cole County circuit judge who oversaw the case, approved the wrongful death settlement on December 31. This resulted in a $4 million settlement for the plaintiffs.
