The crash occurred on August 1st, 2024, at 4:25 PM on Route K, half a mile south of Luray. A 16-year-old boy was operating a 2021 Can Am ATV headed southbound on Route K. The vehicle travelled off the right side of the roadway and struck several trees before ejecting both the driver and his 13-year-old passenger. The 16-year-old driver was pronounced dead at the scene by Clark County Coroner Edwin Wilson. The 13-year-old sustained serious injuries and was transported to the University of Iowa Hospital by Air Evac Helicopter. The ATV was totaled in the accident and was removed from the scene of the crash by the owner.
Offroad vehicles like the Can-Am ATV can be extremely dangerous, especially when they are driven on roadways that are typically occupied by larger high-speed vehicles. Individuals are also not required to carry liability insurance for these vehicles, which complicates the recovery process when crashes do happen. Because of this, it’s important to seek out the guidance of an experienced personal injury attorney. One potential avenue for recovery is a product liability claim against the manufacturer of the vehicle.
