In December of 2013, surviving parents of a 12 year old minor child involved in an automobile accident with a dump truck, settled with the Missouri Highway and Transportation Commission for $875,000. The case was file in Macon County in front of the Honorable Judge Rick Tucker.
Wrongful death lawsuits involving minor children are often times difficult cases for juries to assess. Once the jury determines liability, they are required by Missouri law to place a value on the life of a minor child. Something that many would consider to be unmeasurable. The plaintiff’s attorney’s job is to demonstrate to the jury how to place value on human life by making up for the losses suffered by the surviving parents.
No parent should ever have to bury a child. Even though the United States is the safest country in the world, these types of deaths still occur. Making the defendants pay the full value of the loss of life, is one of the best ways to ensure that our community remains safe for everyone.
