On April 1, 2010, Plaintiff was on his way home in Jefferson City when his vehicle was hit head-on near the Missouri River Bridge. The plaintiff was taken by ambulance to Capital Regional Medical Center and then transferred to University of Missouri Hospital in Columbia. Plaintiff was diagnosed with a cervical compression fracture that was stable and also a small subdural hematoma. Neither of the injuries were life threatening or caused any medical intervention besides observation. Plaintiff was off work a couple of months due to the pain associated with the compression fracture in his neck. Plaintiff filed suit in the Callaway County Circuit Court in Fulton, Missouri. This Court is in the same Circuit as the Boone County Circuit Court in Columbia, Missouri. After several months of litigation, the case settled on April 21, 2011 during a mediation with senior judge Bob Russell from Sedalia, Missouri.
