On January 19, 2012, a 23 year old female was attacked by several pit bulls near her home in Sarcoxie, Missouri. Following emergency medical treatment, the young woman had two subsequent surgeries relating to the dog attacks.
The defendant’s insurer claimed that the injuries were pre-existing. After several months of litigation, the insurer finally agreed to tender its policy limit of $300,000 for settlement of the claims.
Dog bites under Missouri law are typically considered strict liability.
