On Friday, December 27th, 2019, near 5:00 p.m., plaintiff was driving westbound on Nifong Boulevard in his 2019 Honda Insight. Plaintiff entered the left turn lane on Nifong Boulevard towards the Bedford Walk Subdivision with his left turn signal activated. As plaintiff sat stopped in the left turn lane, defendant exited a parking lot on the north side of the roadway and attempted to make a left turn onto eastbound Nifong Boulevard. In doing so, defendant’s 2017 Toyota Highlander collided head-on with the front of plaintiff’s stationary vehicle.
Following the collision, plaintiff was diagnosed with left L5-S1 herniated nucleus pulposus with radiculopathy, and complex regional pain syndrome of his right upper extremity. Plaintiff underwent a L5-S1 laminectomy and medial facetectomy and microdiscectomy. Following a successful spinal cord stimulator trial to address ongoing low back pain and lumbar radiculopathy, plaintiff received a spinal cord stimulator on December 14, 2021.
Settlement was reached with defendant’s insurance carrier prior to litigation.
